How can one say that they wanted to apply in EB2, but their lawyer said they should apply in EB3?
As pointed out by pappu, Category is determined by job requirements and not the summary qualifications of the beneficiary.
If you sign and say that the lawyer said you should apply in EB3/EB2/whatever, you are essentially stating that lawyers were involved in fabricating the job requirements. This is the same problem that is causing Fragomen clients to be investigated/audited.
This is just an advice. I am prepared to support IV and the members in whatever we decide to follow.

How would you define the relationship between India and Indonesia?
India and Indonesia enjoy a very warm and �strategic partnership� in the region and this has grown by leaps and bounds over the last few years. The trade between the two nations has outgrown the set targets well before schedule showing the strong bond the two nations enjoy. In 2005, both the countries set a target of achieving $10 billion trade turnover by 2010 against $4 billion at that time. We have been able to achieve that target in 2008 and hope to end the 2010 fiscal with $12 billion trade turnover which speaks volumes about the complimentary nature of our people and economies.
How do you see this graph progressing in future and what in your opinion should be done to give a new dimension to this relationship?
As the global economy is still in the recovery stage and the Western countries are still grappling with various economic issues, this provides a huge opportunity to both India and Indonesia to capitalise on the situation. Both the nations need to have a more diversified basket of goods and services to take the economic partnership between both the countries to a new level. We need to set up more institutional mechanisms for Business to Business and Business to Government negotiations. As I mentioned, India-Indonesia trade has already touched $10 billion during January-October 2010 and could cross $12 billon by the year end. This target is likely to be doubled to $24 billion when President Susilo Bambang Yudhoyono visits India to be the chief guest at the Republic Day Parade on January 26 and also holds talks with Prime Minister Manmohan Singh.
Although, the trade among the two economies has grown tremendously, people to people exchanges and international transport linkage remain an area of concern. What is your take on that?
There have been some issues pertaining to direct links between the two countries but negotiations are on with the Indian counterparts to link Jakarta directly with major Indian cities. Tourism is another major area where Indonesia has much to offer to the ever growing outgoing number of Indian tourists. Efforts are on to have direct flights from Jakarta to New Delhi, Mumbai, Bangalore, Chennai and Kolkata. It is important that with growing trade, both the nations should provide easy access to their people and the business community at large.
What are the potential areas of investment that Indonesia could offer to the Indian business community?
There is an exponential growth in inter-connectivity in Indonesia and this is a huge potential market for Indian investors in this sector. Indonesia offers huge potential and opportunity in the automobile sector, textiles, engineering products � heavy machinery being a good area for cooperation � electronics, consumer products, processed and manufactured goods, pharmaceuticals, creative industry, mining, agro-based products, oil and gas, mining support services, rubber goods, infrastructure and real estate. We hope that India will be the number one investor in Indonesia in the next few years.
How do view the visit of the Indonesian President to India?
My visit to India is aimed at a follow-up on a number of bilateral issues as part of efforts to improve trade between the two countries and to prepare for the visit of the Indonesian President to India in early 2011. Mr. Yudhoyono would be in India to enhance the two countries' economic partnership. The joint study group on the Indonesia-India Comprehensive Economic Cooperation Agreement has already submitted its report and a final view is likely to be taken during the visit of the Indonesian President. We need to take it further to have a far-reaching and wide spectrum agreement for giving a new thrust to future bilateral trade, economic development and investment cooperation between the two countries.
How does Indonesia view the global multilateral trade talks, also called the Doha Round, for the future of the global economic recovery?
There is little doubt that the multilateral trade links in developing countries will be a significant driver of economic recovery and growth. There is a very strong call to safeguard the world trade system. We need a strong political will for that. I cannot emphasise enough the risk of a failure in a multilateral trading system for a developing country. We firmly believe that for the global economic recovery, it is important that the Doha Round be completed without any further delay and an equitable trading regime is put in place.
What are your areas of concern where you feel that the Indian economy could open up?
We strongly feel that India should open up its retail sector where Indonesia has a lot to offer through its own marketing chains. Similarly, banking is an area of lot of opportunity and that needs to be addressed by the Indian counterparts. We are hopeful that the India-Association of Southeast Asian Nations (ASEAN) agreement on services and goods would be put in place by March 2011 before the India-ASEAN summit. The ASEAN is in favour of 10 plus one formula whereas India wants a one plus 10 formula in this regard. We hope to convince India about the ASEAN stand which is unlikely to change. We hope India would see reason and is able to finalise the deal by March next year.

First off, we are here to get our GC faster so the effort is commendable.
However, I was also wondering about the old interpretation of the law. After the EB2-ROW numbers fall through to EB3-ROW and presumably make it current, the excess numbers go to EB2 China and India or does it go to EB3 China and India? Glad that someone else also caught this.
In the old interpretation after EB3ROW, it would be EB2C and I and then finally EB3I.

I completely agree with you.. I seriously dont understand what pride/ownership people feel by making 5% or best case 20% downpayment, Where the bank owns most of the house. It only truly yours when you have fully paid for it. To cite comparisons to our parents is plain foolish. Most of our parents bought their first homes by outright paying for it and having the home in their own name and not any BANK. Dont get me wrong, Not that i am pro renting and against home buying. I hope to have a bank financed home like everybody else in the near future. But i seriously would not feel any pride of ownership without actually owning it in the real sense. I fully own both my cars and feel proud about them :).

Lou knows it all; he knows it is the L-1 visa holders and not the H1B visa holders. But his viewers know what H1b is and have never heard of L1. So it helps him to cite H1B. He has shown "figures with 0 tax returns" on his show at times; they are from ppl who are now on H1B but were on L-1 in the past when they submitted the 0-tax returns.

People will jump to the ship which goes faster...Thats the bottom line, If tomorrow for some reason EB3 ship moves faster than EB2 ship then you would also jump your EB2 Ship and go to EB3 ship as most other people including me. Focus your energy on some positive action items which benefit the community.

I live in NJ close to the cherry hill area and i am looking to buy only in Burlington county. I have been living here for about 9 years now and so far haven't thought of investing here. I invested in india and the investment appreciated 4 times or more so i am happy about the decision. I actually needed a bigger place now and i am not seeing that as a investment but if it turns out that way that's fine with me. I just wanted to find out what are people's experiences with the house escpecially for those who are under H1/EAD.

I would say I'm doing alright for only being in the workforce for 2.5 years, and I still have to live with my parents. Home prices here are unjustifiably high. On top the ridiculous home prices, I have to figure in the MINUMUM of $500 a MONTH in property taxes due to the complete ineptitude and corrupt nature of my state's government (if you want a never ending source to write about, this would be the place). The AVERAGE property tax in NJ is $6,800/year = $566/ month. Looking at a condo also doesn't work because you can't find a place with association fees of less than $250/month, so no point in paying a lower price for a condo. The ones that are still nice w/ 2 br. & 1 bath list for $300k. Between fees and taxes, you are down $700/month and haven't even gotten to your mortgage yet. I have no choice but to wait and HOPE the economy continues to crumble, while hoping that I stay employed throughout the whole ordeal. All of these action the Fed and the Gov't are taking to soften the blow are doing nothing but screwing me and other first-time buyers. They should just let the bottom fall out already so that people my age can even have a chance to survive on our own.

Also, Fed rate cuts also don't always translate to better mortgage rates. Lenders aren't thrilled about locking buyers into fixed low rates.

Housing prices double in less than 5 years. Then they go down about 10% such that in the last six or seven years, prices have gone up only 80%. So now houses are suddenly a bargain because they aren't quite as overpriced as they were last year? That's like my neighbor joking that gas prices are cheap when they go below $3 a gallon. Houses have a long way to go before they are a good value. You are much better off renting from someone who is desperate to not sell their house for a loss. After a year of renting, you can get that house for less than today's cost plus a year of rent. Oh, and one other thing. Get a 30 year fixed loan with the lowest rate you can find. Make sure you pay attention to the fees, so you are covered there. Go through the process with at least two separate people, so you can easily switch when one tries to screw you. The last thing you want is an ARM when interest rates are sure to go up when the screaming about inflation reaches Washington DC.

Houses have a long way to go before they are a good value. You are much better off renting from someone who is desperate to not sell their house for a loss. After a year of renting, you can get that house for less than today's cost plus a year of rent. Oh, and one other thing. Get a 30 year fixed loan with the lowest rate you can find. Make sure you pay attention to the fees, so you are covered there. Go through the process with at least two separate people, so you can easily switch when one tries to screw you. The last thing you want is an ARM when interest rates are sure to go up when the screaming about inflation reaches Washington DC.

Desi consulting comapanies will not be affected. Consider this, if this bill becomes you can't transfer Visa and stick to the same employer. They can pay whatever they feel like paying (may be $7 per hr) and abuse the way they want. we will continue to extend the Visa and work as slaves thinking that this will get over one day like the Green card mess.

I understand your point of view, I used to work in solar energy. When i completed my post graduation most of the jobs required a USC (this was 10 yrs ago). I had to switch to software related jobs.
For me the number one priority is how Obama will handle the Skilled immigration issues. will he guided by Sen Dick Durbin, who at the moment seems to be his policy wonk. That will be a disaster for us. They have no intension of supporting skilled immigrants. We will will have to make some serious decisions if he is elected.
How many of us want to continue to stay in limbo...i dont.

huh? another shocker (atleast for me): what is the issue with using AC21 to go from a consulting job to a permanent one? As long as title and duties say the same. If I am consulting at a client site, cant I use AC21 to join them fulltime 6 months down the line? My duties etc remain exactly the same.

Some people with approved 140's from 2002 and 2003 had the reopened by uscis and they started applying current day memorandum and current day adjudication standards to cases which were already approved. A number of people had their 140's revoked by uscis stating they were approved in error.
Chennai consulate and California service center both treat the staff augmentation companies as not the employer in "common law" context. That is; you are not in their control. that is why they always ask for letter/contract from the end client.
California service center was just starting to treat the 140's in the same manner before they stopped doing 140's. They were denying/revoking 140's because a company did not have a full time and permanent job for them.
Now;texas and nebraska do not do this. But with all of these legal wranglings; complaints by people; h-1b denials, consulate 221g's, etc.; eventually this could have an impact.
Let's say you are working at Client A. You work for B. You don't like their ratio; so you move to employer C, who gives you a better ratio but you still work at client A. Then you hop over to employer D because they process labors in a fast state or it is a substitute labor. Now; you file 140/485 and after six months you decide to join client A using AC21. I think one needs to consider both cash flow and quality of life. Apartment living with kids is not very pleasant, a house with a yard is really the optimal scenario. Mortgage payments may be comparable with rent, depending on your location, but utility bills are greater in a house. Then there are tax issues, whereby you can deduct the interest paid, and you are also building equity.
It's very complex, and our immigration status is just one more complication. However, like the Bible says, "he that regardeth the wind shall not sow". I think if you are at that time of life and you are planning to settle in the USA just go ahead and do it. I did it in my second year of H1B and it is now 5 yrs later. I am now in 485 stage and in the meantime I have built some equity and have no regrets.

Try asking Congress members what the 2G controversy is all about, and they will look quite blank. They have been conditioned to believe that 2G is short for the two Gandhis, Sonia and Rahul, and any other combination is beyond their comprehension. Mention 3G and the plot thickens with Priyanka added to the mix, even though she's now a Vadra. In Congress circles, however, a Gandhi is a Gandhi, and will smell just as sweet (with due apologies to Shakespeare).
Back to the learning curve and the acronyms that everyone's so concerned about. Here's the first lesson in the Scamsters Dictionary. 2G led to CAG which in turn led to CBI which took it to DoT. Then the trail led to TRAI which, in turn, has led to all sorts of connections to the DMK in Chennai and elsewhere, made a sharp U-turn, and moved back to DIAL. And now we have the ED getting involved, trying to ensure that the PMLA has not been violated. If he indeed was affiliated with the USCIS, I would want to hear his take on this even more. We are trying to understand what can and cannot be done in terms of self employment while on AOS and who better to answer this, than a USCIS representative.
