Good talent also needs to make up its mind as to which company to stick to. The "future job" labor petition is so full of holes that its misused lot more than its used.
Its not so simple though. Even after finding a good company to stick to, you should not make up your mind to remain stagnant. When you work for about 5 years, you will be faced with a situation where you are asked to take on more responsibility.
The way things are with the current process, if you want to progress in your career and take on a new challenge (eg: database programmer to a DBA/architect), that would require a new LCA since there is a significant change in the responsibilities.
Also at big companies, there are several lines of businesses which are structured as if they are companies by themselves. If you want to shift between LOBs within the same big company, that would also require a new LCA.

I saw posts of several members extremely skeptical of the whole idea, even went on calling it stupid, crazy and useless. Some made mockery suggesting sending dead fish etc. I don't see any more posts from them.

None of country gives direct citizenship without residency card. Except some extra ordinary cases.
Even local US people will oppose it. Day you become USC , more responsiblity on govt. Not only money wise but so many things govt need to give you as USC.

The key here is revocation vs. substitution. Per discussions with immi attorneys, AC21 portability is not explicit on what needs to be done if I140 is substituted by previous employer and NOT REVOKED, and the applicant is eligible for changing jobs (same desc and 180 days pending). The fact is that this loophole leads to illogical scenario--2 applicants taking benefit from same I140.
Question to you and other forum members: Is there a thread on this specific topic?

Who said that those 10 guys are committing fraud. They are going by the books, which allow them to file GC for future employment. Even from the employer standpoint, you cannot prove that any fraud has been committed.
Why don't you just ask those 10 guys you know are comitting fraud ( by not joining the desi consulting companies and trying to workaround etc ) which company\companies they are working with and then file a complaint with DOL about them. I am sure DOL would surely look into their workings and will very very surely find out that they are doing something illegal in other things ( even if this is not one of them ). Those companies will get blacklisted and will set an example for other companies.
But I don't think you should stop anyone who is doing it legitimately. If one qualifies for EB2 and has been in the queue for a long time he has the right to do it.

Yes, unless your h1b comes with a i 94 extension - you have to get it stamped as per my understanding. Only h1b transfers come with i 94 extensions attached. Gurus can correct me if I am wrong

To all others like me, who are hesitant and are not sure about the talking points. Below is something that can help.
You would most likely be talking to a person taking messages and not the congressman/woman directly.
And you also dont have to explain them the details of the bill, as they are very well aware of it. All you have to tell them is it is about HR5882.
After one or 2 calls, my message was standardized and this is what I used in all the calls.

I would like to express my support for the bill and would like to request the support of Congressman/woman for the bill. Not sure how much help it will be, but surely cannot hurt. It would atleast draw their attention due to the large call volume. Yes, some offices told me that they were receiving lot of calls for this bill.

In effort to make legislators and people aware of legal immigration issues, we should take help of media.This would be most effective.
Hiring a lobbying firm to pursue our issues with legislators is a good idea but it should be accompanied with media awareness as well.This is money intensive project and it will take time to reach its target of 100k.We need some other channel of awareness open as well and we need to do that soon so that it has some effect on Feb bills.
People are not aware that we are going thru such long waits to get immigrate legally.This issue needs to be highlighted.
Lawmakers would listen to legal immigration issues if they read in leading newspapers NYT and Washington Post. These newspapers are very influential.

I recently had to apply for a UK transit visa and the process went smooth as ever. I had to answer a lot of questions for both my wife and myself but after I have done that the process was easy. We just had to show up for finger printing just like for our 485s, send all the necessary documents to the correct address by (reliable) mail and just got emails that our visas have been approved. I have flown with BA before and their service is far better than any other airlines I have flown with before.
I have flown lot of airlines ..I was in merchant navy before. all airlines suck or are o.k (depends on yr view) i.e. they give you standard service.
the fact that you need a transit visa is stupid. they want to make money and in my view who ever pays for a visa for transit is a sucker.all the european airports who need TV control their airports ..not even a fly can go out unless they pass immigration customs etc - so why do they need visa !!. service in an airline depends on the mood of attendants ..so just based on one flight experience - dont say that BA is better than others.

If there is one thing I learned wrt immigration, it is do things ASAP. Never postpone anything at all. As much as possible get first in the queue.
A general piece of advice: Never reject an option you don't have. [this is more to do with folks who say, "I am only in year 1 in h1..I don't know if I need gc..let me see after 2-3 years.." - guess what einstein, it is easy to give up your gc after you get it, then to get it when you desperately need it.]

If clerk is doing this as per instruction means, we are being noticed and that is precisely what we wanted anyways. I don�t think USCIS higher ups have any malicious intent. Whole issue may be due to lack of training of IOs.

But it is surprising that such things have been happening for 8 years, everyone talk about it, community gets shit scared and willing to compromise on jobs - accepting fate - going through problems, but no one was interested in moving a step forward and try to address this.
In my opinion, we are not there yet, but are making good progress. We need a lot of letters to go out so that they understand how much this is impacting us, especially hard working immigrants who ply by the rules.

the first contact for the congressman's office is the relevant consulate. so it doesn't hurt. it is a simple process. your boss has to sign a confidentiality release document for you and attach a cover letter. to help your boss, identify the congressman, go to the congressman's website and find out where the forms are, write a draft cover letter etc . you can do this yourself i.e enquire as a constituent just in case you don't want to involve your boss. i think it may be better that it goes through your boss

I think if number of employees are less than 50 then 50% rule will not be applicable(according to 2007 proposed bill). It may be similar to that.
But are n't they proposing 50 % rule.. how can a small desi company afford 50 % US citizen staff ? That is why may be people think consulting companies will not work.
but what I think is it will make them less profitable. Very small body shoppers will go out of business. Med to large indian owner based consulting companies will be less profitable.
